CASE NO. 01-00533-6B1 UNCLEARED AND UNDELIVERABLE CHECKS FROM FIRST DISTRIBUTION Evergreen mailed checks to claim holders for approximately seven per cent of their allowed claims on October 1, 2004. Some of these checks have not cleared Evergreen's bank account within ninety days from when they were issued. Some of these checks were not deliverable due to mail being undeliverable to the address on the Proof of Claim (POC) filed with the Court. SHOULD YOU TAKE NO ACTION, YOUR CLAIM SHALL NO LONGER BE DEEMED TO BE ALLOWED, AND YOU SHALL BE DEEMED TO HAVE NO FURTHER CLAIM IN RESPECT TO SUCH CHECK AND SHALL NOT PARTICIPATE IN ANY FURTHER DISTRIBUTIONS UNDER THE PLAN OF REORGANIZATION OF EVERGREEN SECURITY, LTD.
