On May 10, 2002, the Trustee filed fraudulent transfer suits against seventy-six of the financial advisors for Evergreen Security, Ltd. (Evergreen) to recover commissions and issued a press
release, which is posted at www.evergreencreditorscommittee.com.
On July 16, 2002, the Trustee filed a motion to dismiss his fraudulent transfer suits against the following financial advisors due to additional information obtained by the Trustee:

The Court has ruled that the suit in Adv. No. 02-110, against Harold James Kime and First American Life and Health Insurance Corporation will be tried in December as a test case. The
suits against the remaining financial advisors will be continued until the completion of the test case.
